Cambodian Lawyers and My Pessimism

“Lawyer”, a profession of high social status and standing and so it must be focus destination for a large numbers of prospective graduate students. Cambodia, one of the world’s stigmatized countries, is now emerging into the world stage and proving itself of global capacity. Walking on a track toward catering prosperity for Cambodian people, countless resource is needed; spiritually and materialistically.

One of the most important resources toward prosperity for its people, as firmly claimed by both the governing parties: Cambodian People’s Party and Funcinpec and the opposite party, is the “rule of law.” The scope of this article is to navigate around the rule-of-law environment in Cambodia and the author’s personal perspective. However, before stepping toward rule of law, legal studies and profession would be an indispensable factor.

By and large, legal institutes are being born to convert Cambodia into the civilized country; however, we see that progression is much slower than what we have expected and analyzed, with reference to internal and external resources.

Most of the people see legal practitioners and institutes are falling on the downward spiral, due to Cambodian law schools are lacking behind those of the region and the world, unstable justice systems, legal loopholes, unqualified legal practitioners and one of the most important thing: “protracted conflict over the presidency chair of the Bar Association of the Kingdom of Cambodia (BAKC).” So what are those stated disadvantages? One-by-one brief glimpse into each problem will be depicted in the following.

I. Cambodian Law Schools

The author of this article does not single-mindedly target the state-owned Royal University of Law and Economics alone, but talking about all universities that stipulate Bachelor of Law into their educational curriculums.

Total institution such as the law school shall be the ultimate initiative for students’ professional lives and other like successes. We do not have to follow the West’s style, though their law schools are world widely recognized, but the dean, rector, president and other faculty members shall seek out the way to make their clients truly professional and confident after graduation.

Another problem is in regard to the lecturers. We do and definitely need genuinely professional and experienced lectures to give us the lectures on any specific subject or subject of his or her expertise. In today’s corporate world, law school is no longer an institution to enlighten students’ spirit, but it single-mindedly focus on profit; this would bring great danger to the future of Cambodia.

II. Approaches to Legal Studies

The overall idea learning law is to know that what elements that make law a good law, realizing that whether any law practitioners or politicians are complying or contradicting the law. For all these purposes, neutral and scientific approach to legal study is the must. We do need law school that understand and accept and practice these approaches which are the ultimate initiative toward legal professionalism.

So far, due to political orientation or inference, it makes both the students and lectures hard to realize that what the true world of legal study and practice is.

III. Lawyers’ Consequences

As repercussion from negative points imposed by the law schools, lawyers in Cambodia do not have well prospective and social dignity. It is due to the reason that most of them have not experienced the strict and truly neutral law students’ disciplines, Cambodian people are unaccustomed to having lawyers for conflict resolution and finally the weakness in term of materialism and spirit of the Bar Association of the Kingdom of Cambodia.

However, there is always a way out, instigate the true legal spirit today for its betterment tomorrow.

If you had to go into the hospital or (heaven forbid) died next week, would your loved ones be able to find what they need to manage your affairs? There is much more to organizing than just making sure everything has a home. You need to make sure your important paperwork is PROTECTED and easy to access in the case of an EMERGENCY.

FIRE, FLOOD, OR TORNADO

I first started thinking about the value of protecting important records when my sister’s neighborhood was hit with an F5 tornado. The houses I had grown up around were decimated — in some places, there was nothing left but the foundation. Fortunately, there were very few casualties, but I watched on the news as the community tried to put itself back together again. As I thought about all of the things these people had lost — their homes, their cars, their personal possessions — I realized how difficult it would be to REBUILD your life without paperwork. How long would it take you to file a claim with your insurance company, if you didn’t know your policy number? How difficult would it be to handle your finances if your checks, bank statements, and credit card info was destroyed? How could you get the help you needed without birth certificates, social security cards, and other personal information?

The goal here is not to be pessimistic, but PREPARED. You should keep a list of all your important numbers (bank account, credit card, insurance policies, social security) and contact information (addresses, phone numbers, and your contact person) for anything that you would need if disaster struck. You should also consider storing your vital records (birth certificates, wills, insurance policies) and your list someplace safe — keeping copies in your everyday files for quick reference. Someplace safe means a safe deposit box, a locked drawer at your place of employment, your mother’s house, or a fire safe in your closet. And it’s also a good idea to leave copies of this information with your attorney and CPA — the two professionals who will be most involved with your situation if you do face a major emergency.

IF YOU HAVE TO FILE A CLAIM

Another important piece of paperwork to consider is your HOUSEHOLD INVENTORY. If your personal possessions are damaged or destroyed, the insurance company isn’t just going to write you a check for the amount printed on your policy. They are going to ask you to ITEMIZE everything that you lost and ESTIMATE its value. If you had to, right now, could you make a list of everything that you own and how much it is worth? Probably not. And it would be even more difficult during a time of crisis when you aren’t thinking straight. So the key is to create your list before you are put into that situation.

You have several different options for creating a household inventory. The best choice is to walk around your house with a VIDEO CAMERA and record everything that you own. You are welcome to make comments about your belongings as you film — “We bought that TV last year and it cost $600,” or “Grandma Miller gave us that table; it was made in 1865.” If you don’t have a video camera, just take still SNAPSHOTS of each item. Then, you will need to estimate the year of purchase and the value at purchase of each piece. If you have the receipt, make a copy and clip it to your list. If an item is particularly valuable or an antique, you may wish to have an APPRAISAL done and include the appraisal with your list. Your household inventory should be stored with your other important papers — but don’t just stick it away and forget about it. You need to plan a time each year to update your list — adding on any new items you have acquired since the last inventory.

MAKING IT EASY ON YOUR HEIRS

No one likes to think about death, but it is a fact of life. Grief is hard enough to handle, without having to deal with confusion over the deceased’s paperwork and final wishes. You can make things easier on your loved ones by getting your affairs in order now. Start by creating a DOCUMENT LOCATOR — listing where all of your important papers are stored. And remember that safe deposit boxes are often sealed at death, so keep your funeral arrangements and wills somewhere more accessible. Your family will need to know the location of the following records:

• legal (wills, powers of attorney, trust documents, special bequests, safe combination)

• family (birth/adoption/guardian, social security, citizenship, marriage/divorce, military)

• banking (trusts, loans, list of accounts, statements/cancelled checks, check/passbooks)

• investments (CD, securities, stock/bond/mutual fund, retirement plan, IRA, annuities)

• business (incorporation papers, contracts/agreements, computer back-up)

• deeds/titles/registrations (title insurance, property, home inventory, vehicles)

• insurance (life, other death benefits, property and casualty, health, homeowners, auto)

• funeral instructions (burial instructions, cemetery plot deeds)

• contacts (friends/relatives/business, attorney, CPA, insurance, broker, executor)

Indicate the location of each — at your residence, office, in a safe deposit box (and where the key is!), or with your attorney, accountant, or brokerage house. Be sure to include the address, direction, and any other important contact information.

MEMORIES COUNT AS VITAL RECORDS TOO

Everything we’ve talked about so far related to legal or financial records. But what about your memorabilia? It is just as devastating (if not more so) to lose years worth of photographs and love letters as it is to have your important files destroyed. But you can take some preventative measures to protect your beloved memories, as well. If you are computer savvy, think about scanning your photos and storing them on a CD-ROM (which you put in your fire safe or safe deposit box). If you don’t have access to that kind of technology, at least store your negatives (clearly labeled and organized chronologically or categorically) away someplace safe. In either instance, you can always have your photos reprinted if you need to.

You can do the same thing with physical objects as well. Take PHOTOS of your most beloved possessions, copy your favorite correspondence, and stash them all away in your fire safe. You might even consider getting a fire safe big enough to hold some of your original memorabilia. I purchased a fire safe that looks like a 2-drawer file cabinet — the top drawer holds my photo albums and the bottom drawer is for important paperwork. Just remember that photos and negatives are more sensitive to heat than paper — you will want a different grade of “fire proof” for these items.

The Giant Used Car Tent Sale

One of the things I remember most about San Diego is the GIANT USED CAR TENT SALE that used to happen every weekend in the parking lot of Qualcomm Stadium. As a promotions assistant at a local radio station, we used to have to spend time there once a month or so, giving away prizes to passers-by and generally waste away a Saturday or Sunday morning. I put the name of the event in capital letters because that’s how they advertizement would go; a man practically yelling the words through the radio at you. Like one of those monster truck rallies (”Sunday Sunday Sunday!”) or gun shows or something.

I would never have normally gone to this event if I didn’t have to work there for the station. It seemed like a terrible way to spend a weekend morning. People would drive for miles to get a good deal on a used car, but all I could notice were the sheer numbers of smarmy used car salesmen. They are the some of the worst people on earth, in my opinion.

Someone told me recently that they should set up an auto dealer bonds tent within the stadium parking lot, so that people can make sure they are getting the best deal possible at this event.

A new law going into effect 9/1/05 will likely increase the require for defensive driving online classes in addition to onsite courses and defensive driving video rentings and will grow the total of road tests dealt out by the TX Dept. of Public Safety.

Initiating 1-Sep-05, a drivers safety course will be involved for 100% operators under age twenty-five that pick up a ticket for a moving ticket such as speeding if they want to keep it off their record. This isn’t new in that many cities and parishes already have this requirement. However, many judges in these counties dismiss the class requirement typically in substitution for provisionary cycle in which, if the driver stays clean of any more Citations, the original ticket is dismissed. In general this understanding ordinarily also packs a fee to the municipality in addition to the probationary cycle.

this new law is even more hard-and-fast for those under 18. Motor vehicle operators through the age of Seventeen will be needed to take a road end line text with the Texas Department of Public Safety in addition to the fine and probation if they want to keep their records clean.

Those with very much of personal experience with incurring violations will not be delighted with this law as it shuts a loophole. Prior to this law judges were allowed to exempt drivers under the age of 25 who received a traffic fine from a Drivers Safety Class. Some lawmakers were concerned about teens, especially those who were instructed to drive by their parents versus state endorsed teachers. To site address this concern, they amended the road end line text requirement for those under 18.

Ahead of September 1st, there were two parts that bear on to deferred adjudication of misdemeanors. This just means that if a driver pleaded “no contest” to the traffic sections & then did not violate any further traffic laws for a time set by the court, the fine would be effaced from the driver’s criminal record. One division of the law specifically covers traffic citations indicating that a traffic violator must take an online defensive driving course or attend an alternative defensive driving school or course of instruction in order to have a ticket removed from their record. Misdemeanors are covered in the other section of law allowing judges to define the standard to be reached for “deferred adjudication”. Deferred adjudication means: the driver is placed on probation for a length of time & if driver stays ticket free during this period, the original traffic violation is erased from their record. Deferred adjudication, in addition to the probationary period, usually incurs a fine to the district in which the violation occurred. In many jurisdictions, this second section of the lay has allowed violation to simply fine motor vehicle operators as long as they didn’t get a second citation for some time of time like 6 months.

For automobile operators under the age of twenty-five, Texas law SB 1005 eliminates that flexibility & in fact requires those who receive traffic citations and are under 25 to a take defensive driving online or in classroom setting.

The Texas DPS indicated that an estimated 21,000 teens will take the road trial each year. All state driver’s license offices are gearing up to have officers available to conduct more of these tests. DPS spokeswoman Tela Mange said that these offices already conduct road tests now however as this road test has not been required to obtain a driver’s license for more than decade, most teens don’t take it so more officers will need to be available at both DPS faciltiy. Those that do are usually at the request of their parents. Fortunately for the usually cash strapped young operators, the road line 2 text will only tack on another $10 to their already costly traffic citation experience.

This new law will likely increase the demand for defensive driving online courses as well as onsite courses and defensive driving video rentals.

How To Load A Horse Into A Trailer - Easy As Pie!

If there is an art to getting horses to load in a trailer, then this it.

The first thing that must happen is communication between the horse and his handler. The horse must understand what is required of him and the handler must make it easy to understand.

Thus, you must start by getting the horse to move forward in either direction. After a direction is established then get him moving in the opposite direction. A round pen is excellent for this purpose.

When the horse gets good at moving both directions then it’s time to hook a lead rope to his halter and lunge him left and right. For instance, when you point left, the horse must know to go to your left. And vice versa for going right.

The final result should look like this. You’re holding the lead rope while facing your horse. As you hold the lead rope in your right hand, you hook the middle of the lead rope with your left thumb. Lift it up and point to the left.

Your horse, now knowing what to do, immediately goes to your left. After a circle or two you switch hands and get the horse to go to your right.

When he gets good at that, then send (lunge) him through gate openings, barn door openings, etc. Also, lunge him in smaller spaces to help him deal with his natural claustrophobia. You can do this by lunging him between you and a fence. As he goes back and forth make the space between you and the fence smaller. Be careful not to get stepped on.

Now that he’s good at that, you take him by the trailer. You open the door and let him sniff it. Then you step back and face your horse. You lunge him left and right in front of the trailer while he passes back and forth by the opening.

After all this pointing and sending your horse now knows what you want. You have communicated to him when you point left that he is to move left and so on.

The next step is to face him to the trailer. With his head facing into the trailer and you standing on his left side you then send (point) him into the trailer.

Some horses will simply jump right in the trailer where others may take more work.

If your horse doesn’t go in after pointing and coaxing then take him away from the trailer and make him work. Now you want to convey the idea that being in the trailer means he can relax. Being outside the trailer means he has to work hard. Eventually, he’ll catch on.

Once you have him in the trailer, pet him and let him relax. Talk to him. Let him know how good he did.

Obviously, getting a horse to load in a trailer isn’t rocket science. But you can do it. It takes patience and work

Giant Sequoias - Hiking Boole Tree Loop

The Giant Sequoia trees of California are a site to see. Despite heavy logging efforts, you can still hike through these massive trees on the Boole Tree Loop.

Giant Sequoia National Monument

The park system in central California is incredible. You have Sequoia National Park, the first national park ever designated in the country. Next to it is King Canyon National Park, created in 1940. Surrounding a good portion of these two is the new Giant Sequoia National Monument, designated such by President Clinton in 2000. The three parks form a sanctuary for incredible scenery, including the Giant Sequoias on the Boole Tree Loop hiking trail.

Although directions are included below, I have to mention the drive to Boole Tree is incredible. As you drive through Stump Meadow, you will see some of the biggest stumps in the world and get a real feel for what has been destroyed. The biggest is the Chicago Stump measuring 70 FEET around its perimeter. Sadly, the tree was cut down so it could be displayed in a museum in Chicago in the 1880s when such trees seemed plentiful.

The Boole Tree Loop is only 2.5 miles, but will take a couple of hours since you’ll be staring up in the air like an idiot and looking at some incredible views. Since it is a loop, you can go either direction you wish. The first part of the trail will wind through at least 40 Giant Sequoia stumps that will boggle your mind with their size. Passing these, you’ll head up to a plateau where you can look down upon valleys in the canyon with Spanish Mountain in the distance. Regardless of which way you go, you’ll eventually come upon Boole Tree.

Boole Tree is big, but not as big as many of the stumps you’ll see. Boole Tree stands roughly 275 feet high with a perimeter of some 35 feet. It is estimated to be over 2,000 years old and is one of the biggest living trees in the world. Ironically, the tree is named after a lumber mill owner that spared it. To bad he wasn’t feeling as gracious with the other Giant Sequoias as all the stumps attest.

The Giant Sequoia National Monument is roughly an hour east of Fresno, California. Highway 180 is the most used entrance to the park from the west coast. Upon entering the park, you’ll pass through a ranger station. Drive north from there and hand a left at Grant Grove after traveling just over a mile. Continue until you hit Grant Grove Village. Just after it, you’ll see sign for Stump Meadow. Take a left and start driving. After a couple of miles, you’ll see a parking lot with a sign.

If you’re coming from Los Angeles, the drive will take five hours as will driving from San Francisco. Of course, drive times are dependent on traffic conditions in both cities.

Taking a hike through the Giant Sequoia National Monument is tremendous. It will give you a perspective of Mother Nature that few see.
